Resumo

In examining breaks and continuities between the "old" and "new" unionism, the article discusses how workers at the Companhia Siderúrgica Nacional (CSN) made recourse to the Brazilian CLT and the filing of petitions before the Labor Courts at two different moments: the close of the 1940s and latter half of the 1980s. In recent years the Metalworkers Union in Volta Redonda has filed a significantly greater number of petitions against CSN. This fact prompts reflection on the significance of the law within specific contexts and on the new unionisms creative recourse to channels and institutions usually associated with the old unionism. While for the first generation of workers demands for enforcement of the CLT and appeals to the Labor Courts helped them both to respond to factory despotism and also to collectively construct a notion of rights, for current generations such practices are aimed mainly at expanding conquered rights or at creating new ones.
